This Privacy Policy describes how GN Hearing Care Corporation D/B/A Beltone (“Beltone”, “we”, “us” or “our”) handles personal information that we collect through the Beltone website (www.beltone.com/en-us/) and our other digital properties that link to this Privacy Policy (collectively, the “Site”), as well as through social media, our marketing activities, from our affiliates, and other activities described in this Privacy Policy.

Beltone is part of an international group of companies (“GN Group”) that are owned by GN Store Nord A/S and are engaged in different activities: production and marketing of, for example, hearing instruments, headsets, speakerphones, webcams, accessories, and other services and products. These products and services are marketed under a variety of brands such as Resound, Beltone, Interton, Jabra, Steelseries, Kontrolfreek, Blueparrott, Falcom, and others. However, this Privacy Policy only applies to the Beltone brand. You can find more information about the companies in the GN Group here: www.gn.com.

Personal Information We Collect

Information You Provide to Us

Personal information you may provide to us through the Site or otherwise includes:

  • Contact data, such as your first and last name, email address, mailing address, and phone number.
  • Demographic information, such as your city, state, country of residence, and postal code.
  • Communications data based on our exchanges with you, including when you contact us through the Site, social media, or otherwise.
  • Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
  • Online Hearing Test data, based on the results of your online hearing test conducted through the Site.
  • Appointment data, such as your appointment history and upcoming appointment information with a Beltone Hearing Center, as defined below.
  • Profile data, such as the username and password that you may set to establish an online account on the GN Unified Identity Platform website (account.gn.com) that enables you to access your account on this Site, date of birth, biographical details, photograph or picture, preferences, information about your participation in our promotions or surveys, and any other information that you add to your account profile.
  • Chatbot data, such as any information that you choose to provide in your message if you choose to use our Chatbot feature. Note that our Chatbot will only ever ask for your name, phone number, and email address; any other personal information you provide is at your own discretion and not required for your use of the Site.
  • Order data, such as information relating to or needed to complete your orders on or through the Site, including order numbers and transaction history (products and services purchased from us, such as hearing aid devices, remotes, accessories, and cleaning supplies).
  • Payment data, such as information needed to complete transactions, including payment card information or bank account number.
  • Relationship data, such as information about a third party you provide to us, like a caregiver or family member.
  • Our apps, such as the Beltone Tinnitus Calmer™ mobile app, Remote Care Live feature in the HearMax™ app, and other apps.
  • Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.

Third-Party Sources

We may combine personal information we receive from you with personal information we obtain from other sources, such as:

  • Public sources, such as government agencies, public records, and other publicly available sources.
  • Data providers, such as information services and data licensors that provide demographic and other information.
  • Marketing partners, such as joint marketing partners and event co-sponsors.
  • Beltone Hearing Centers, our network of local and independently owned and operated hearing care centers, professionals, distributors, and resellers that sell Beltone products through an agreement with us (a “Beltone Hearing Center”).
  • Affiliates, the members of the GN Group, such as our parent company and other affiliates and subsidiaries.

Automatic Data Collection

We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Site, our communications, and other online services, such as:

  • Device data, such as your computer or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi‑Fi, LTE, 3G), and general location information such as city, state or general geographic area.
  • Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Site, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
  • Communication interaction data, such as your interactions with our email, text or other communications (e.g., whether you open and/or forward emails). We may do this through use of pixel tags (also known as clear GIFs), which may be embedded invisibly in our emails.

Cookies and Similar Technologies

Some of the automatic collection described above is facilitated by the following technologies:

  • Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site. Cookies used on our sites include both “session cookies” that are deleted when a session ends, “persistent cookies” that remain longer, “first party” cookies that we place and “third party” cookies that our third-party business partners and service providers place.
  • Local storage technologies, like HTML5, that provide cookie-equivalent functionality but can store larger amounts of data on your device outside of your browser in connection with specific applications.
  • Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.
  • Session-replay technologies, such as those that employ software code to record users’ interactions with the Site in a manner that allows us to watch video replays of those user sessions. The replays may include page views and engagement during those sessions. These replays help us diagnose usability problems and identify areas for improvement.

How We Use Your Personal Information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

Site Delivery

We may use your personal information to:

  • Provide, operate, and improve the Site and our business.
  • Communicate with you about the Site, including by sending announcements, updates, security alerts, and support and administrative messages.
  • Communicate with you about your appointments.
  • Understand your needs and interests, and personalize your experience with the Site and our communications.
  • Provide support for the Site, and respond to your requests, questions, and feedback.

Schedule an Appointment

When you or your caregiver use our Book an Appointment Tool, we, the Beltone Hearing Centers, and our service providers may process your name, contact information (email and phone number), your location, your appointment preferences, as well as any other information you include in your request. The purpose of our processing is to facilitate your or your caregiver’s request for a hearing care appointment and connect you with a Beltone Hearing Center you have previously visited or a new clinic in your area to conduct your hearing care appointment.

Online Hearing Test

When you take our online hearing test, we will process your answers to the hearing-related questions and the results of the hearing test in order to provide you with non-clinical information about your current hearing.

Research and Development

We may use your personal information for research and development purposes, including to analyze and improve the Site and our business (including but not limited to the manufacturing of hearing aid devices and remotes). As part of these activities, we may create aggregated, de‑identified or other anonymous data from personal information by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes, including to analyze and improve the Site and promote our business.

Marketing

We, the Beltone Hearing Centers, our service providers, and our third-party partners may collect and use your personal information for marketing purposes:

  • Direct marketing. We may send you direct marketing communications. You may opt out of our marketing communications as described in the Opt-out of marketing communications section below.
  • Interest-based advertising. Our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with the Site, our communications, and other online services over time, and use that information to serve online ads that they think will interest you. This is called interest-based advertising. We may also share information about our users with these companies to facilitate interest-based advertising to those or similar users on other online platforms.

Compliance and Protection

We may use your personal information to:

  • Comply with applicable laws, lawful requests, and legal processes, such as to respond to subpoenas or requests from government authorities.
  • Protect our, your, or others’ rights, privacy, safety, or property (including by making and defending legal claims).
  • Audit our internal processes for compliance with legal and contractual requirements or our internal policies.
  • Enforce the terms and conditions that govern the Site.
  • Prevent, identify, investigate, and deter fraudulent, harmful, unauthorized, unethical, or illegal activity, including cyberattacks and identity theft.

In some cases, we may specifically ask for your consent to collect, use, or share your personal information, such as when required by law.

In addition to the other uses included in this section, we may use the cookies and similar technologies described above for the following purposes:

  • Technical operation. To allow the technical operation of the Site.
  • Functionality. To enhance the performance and functionality of our services.
  • Advertising. To help our third-party advertising partners collect information about how you use the Site and other online services over time, which they use to show you ads on other online services they believe will interest you and measure how the ads perform.
  • Analytics. To help us understand user activity on the Site, including which pages are most and least visited and how visitors move around the Site, as well as user interactions with our emails.

How We Share Your Personal Information

We may share your personal information with the following parties and as otherwise described in this Privacy Policy or at the time of collection:

  • Affiliates. Our corporate parent, subsidiaries, and affiliates, for purposes consistent with this Privacy Policy.
  • Beltone Hearing Centers. Our Beltone Hearing Centers include a nationwide network of local and independently owned and operated hearing centers that specialize in selling our products. We will share personal information that is needed for these Beltone Hearing Centers to provide the services and appointments that you have requested.
  • Site providers. Third parties that provide services on our behalf or help us operate the Site or our business (such as hosting, information technology, appointment schedulers, customer support, email delivery, consumer research, marketing, website analytics, payment providers, and shipping/courier companies).
  • Advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.
  • Business and marketing partners. Third parties with whom we co-sponsor events, with whom we jointly offer products or services, or whose products or services may be of interest to you.
  • Professional advisors. Professional advisors, such as lawyers, auditors, bankers, and insurers, where necessary in the course of the professional services that they render to us.
  • Authorities and others. Law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate for the compliance and protection purposes described above.
  • Business transferees. Acquirers and other relevant participants in business transactions (or negotiations of or due diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale or other disposition of all or any portion of the business or assets of, or equity interests in, GN Store Nord A/S, our parent, our affiliates, or our subsidiaries (including in connection with a bankruptcy or similar proceedings).

Opt-Out of Marketing Communications

You may opt out of marketing-related emails, texts, calls, and direct mailings by following the opt-out or unsubscribe instructions at the bottom of the email, texting “STOP,” following the instructions during the call, or by contacting us. You can also manage your communications preferences (mail, email, phone, text) for Beltone at any time by clicking on the “Manage Contact Preferences” button on the bottom of the website, selecting your communication preferences, and clicking “Submit”.

Please note that if you choose to opt out of marketing-related calls, emails, texts, or direct mailings, you may continue to receive appointment-related and other non-marketing emails, texts, calls, or direct mailings.

We need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.

“Sales” of Personal Information and Targeted Advertising

For purposes of Applicable State Laws, we do not “sell” personal information, nor do we have actual knowledge of any “sale” of personal information of minors under 18 years of age as the term “sell” is commonly understood. That said, we may share information with third-party advertising partners for the purpose of promoting our services as described above, such as for cross-context behavioral advertising and targeted advertising.

To the extent that such sharing is considered a “sale” or “sharing” or disclosing for targeted advertising under California or other Applicable State Law, you may limit such sharing by:

  • Exercising your privacy choices and rights by following the instructions found above in the section titled Your Choices or below in the section titled Your Rights.

The categories of data we share for cross-contextual advertising and targeted advertising include:

  • Inferences about individual preferences, characteristics, and behaviors

Each of these categories may have been shared with advertising networks and data analytics providers for the purpose of providing targeted advertising and marketing.

California Consumer Privacy Act Disclosure

This disclosure is for the purpose of explaining how we collect, use, and disclose personal information relating to California residents covered by the California Consumer Privacy Act of 2018 (“CCPA”) (for more information on the CCPA, please visit https://oag.ca.gov/privacy/ccpa). Your Rights

Subject to Applicable State Law and depending on the state in which you reside, including, but not limited to, California, Connecticut, Colorado, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nevada, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, you may have certain privacy rights regarding your personal data.   2. Access to your personal information. You may have the right to obtain a copy of your personal information in a portable and, to the extent technically feasible, readily usable format.
  3. Correct inaccuracies in your personal information.
  4. Delete personal information we collected from you, subject to certain exceptions provided by applicable laws.
  5. Opt out of the processing of personal information for purposes of sale, profiling, or targeted advertising.

You may exercise your rights by submitting a request:

If legally required, we will comply with your request upon verification of your identity and, to the extent applicable, the identity of the individual on whose behalf you are making such request. To do so, we will ask you to verify data points based on information we have in our records. We will work to process all verified requests within 45 days. If we need additional time to respond, up to an additional 45 days, in order to process your request, we will provide you with an explanation for the delay. We will not discriminate against you for exercising your rights. However, some services we offer require usage of personal information, so compliance with your request may impact those services.

In some instances, we may not be able to honor your request. We will advise you in our response if we are not able to honor your request within 45 days. You have the right to appeal our decision to not act on a request within a reasonable time after our response.

You may appeal a decision related to your rights by:

If your appeal is denied, you may have the right to file a complaint with your state Attorney General or other regulating authority; however, we would appreciate the chance to deal with your concerns before you approach these authorities.

Supplemental Notice to California Residents

“Shine the Light” Law

California Civil Code Section 1798.83 allows our California resident website users to request, once a year and free of charge, certain information regarding our disclosure of personal information to third parties for their direct marketing purposes, if any. To make such a request, please contact us by email.

Other Websites and Services

The Site may contain links to websites, mobile applications, and other online services operated by third parties. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that we are affiliated with, any third party. We do not control websites, mobile applications, or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies of the other websites, mobile applications, and online services you use.

Security

We employ a number of technical, organizational, and physical safeguards designed to protect the personal information we collect. However, security risk is inherent in all internet and information technologies, and we cannot guarantee the security of your personal information.

International Data Transfer

We are located in the United States, but we have international affiliates in the GN Group, including our parent company in Denmark, and we may also use service providers and third parties that operate in other countries. Your personal information may be transferred from the United States to a foreign country or from a foreign country to the United States, as applicable to the purpose, and the privacy laws of such other locations may not be as protective as those in your state, province, or country.

Children

The Site is not intended for use by anyone under 18 years of age. If you are a parent or guardian of a child from whom you believe we have collected personal information in a manner prohibited by law, please contact us. If we learn that we have collected personal information through the Site from a child without the consent of the child’s parent or guardian as required by law, we will comply with applicable legal requirements to delete the information.

Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Site or by other appropriate means. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Site after the effective date of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.
